have been working there for few days. One day, the management suddenly<br>
announced that the company is going to dismiss all of us due to the partnership
matters.</b></p>
<p><b>Will I get the compensation of dismissal from the company even though
I am still under probation?</b></p>
<p><b><font color="#990000">REPLY:</font></b></p>
<p>It first depends whether you are covered by the Employment Act. To be
covered you should be earning RM 1500 and below. If you are earning above
this but below RM5,000 per month you can seek action at the Labour Dept
provided the compensation you are seeking for is spelt out in your legal
employment contract.</p>
<p>Under the Employment Act due to your short service you will not be paid
for termination benefits but only for the notice period as your Employer
must give you at least 4 weeks notice. If he serves you notice and asks
you to work through then you will not receive any payment except your
wages but if he decides to ask you to leave before the notice period ends
then he has to pay you accordingly.</p>
